1. About these Terms

1.1 These Website Terms of Use apply to anyone who visits or uses operationsintelligence.com.au and its pages, forms, free tools and downloads (the "Website"). The Website is operated by WorkflowU PTY LTD ABN 53 652 175 570 trading as Operations Intelligence ("OI", "we", "us", "our").

1.2 By using the Website, you agree to these Terms. If you don't agree, please don't use the Website.

1.3 These Terms cover use of the Website only. If you engage OI for paid Services, our Business Terms and Conditions and your accepted Proposal govern that engagement. If there is any conflict, the Business Terms and Conditions prevail.

1.4 If you use the Website on behalf of a business, you confirm you are authorised to accept these Terms for that business.

2. Using the Website

2.1 You may use the Website for your own business research and to engage with OI. You must not:

• use the Website for anything unlawful, misleading or harmful;
• submit false, misleading or someone else's details in any form or tool;
• scrape, copy, harvest or bulk-download content, data or tool logic, whether manually or using bots, scripts or AI agents;
• reverse engineer, probe or attempt to bypass the security or limits of the Website or its free tools (including "one try per contact" limits);
• interfere with the Website's operation, including by uploading malicious code or overloading it; or
• use the Website or its content to build or market a competing product or service.

2.2 We may suspend or block access to the Website, or to any free tool, for anyone who breaches these Terms.

2.3 We aim to keep the Website available and accurate, but we may change, pause or remove any page, tool or content at any time without notice.

3. Free Tools and Results

3.1 The Website offers free tools, including the AI Business Finder and other calculators, assessments and checklists ("Free Tools"). Free Tools are provided to help you spot opportunities in your business. They are free, and using them creates no contract or obligation for either you or OI.

3.2 Results from Free Tools (for example estimated hours lost, costs of manual admin or revenue recoverable) are general estimates. They are calculated from the answers you give and from general assumptions, and do not take your full circumstances into account. They are not a quote, a promise of results, or financial, legal, tax or professional advice.

3.3 Some Free Tools use artificial intelligence to generate results. AI can produce inaccurate or incomplete outputs, so check any result before you rely on it for a business decision.

3.4 To see your results, you may need to provide your name, email address, phone number and business details. Some Free Tools are limited to one use per person or business.

3.5 We may change how a Free Tool works, or withdraw it, at any time.

4. Enquiries, Bookings and Communications

4.1 Free Strategy Sessions. Booking a Free Strategy Session through the Website is free and does not commit you to buy anything. Please give at least 24 hours' notice if you need to reschedule. We may decline or reschedule a booking at our discretion.

4.2 Contacting you. When you submit a form, use a Free Tool or book a session, you consent to OI contacting you by email, SMS and phone about your enquiry, your results and OI's services. You can unsubscribe from marketing emails or SMS at any time using the link or instructions in the message, or by emailing [email protected]. We will action unsubscribe requests within 5 business days.

4.3 Call recording. We may record calls and video sessions for quality, training and note-taking purposes. We will tell you at the start of the call if it is being recorded.

4.4 AI assistants. Some chat, messaging or voice responses on the Website or in follow-up communications may be generated by an AI assistant. You can ask to speak with a person at any time.

4.5 Accurate details. You must give accurate contact details and only submit details for yourself or a business you are authorised to represent.

5. Intellectual Property

5.1 OI owns, or is licensed to use, all content on the Website, including text, graphics, the OI name and open ring logo, case studies, videos, frameworks (including "Find It. Fix It. Automate It."), Free Tools, their questions, logic and calculations, and the Website's design and code.

5.2 You may view, download and print pages for your own business use. You must not copy, reproduce, republish, adapt, sell or distribute any Website content, or use it to train an AI model, without our prior written consent.

5.3 Nothing on the Website gives you any licence to use OI's trade marks, branding or Free Tools other than as set out in these Terms.

5.4 If you send us feedback or ideas about the Website or our services, we may use them without any obligation to you.

6. Case Studies and Testimonials

6.1 Case studies on the Website describe real OI engagements. Unless the client has agreed to be named, details that could identify them have been removed or generalised.

6.2 Results shown in case studies reflect what one business achieved in its own circumstances. They are not typical results or a promise that your business will achieve the same outcome. Your results will depend on your market, team, data and follow-through.

6.3 Any testimonial on the Website is from a genuine client, published with their permission, and has not been paid for.

7. Third-Party Links and Platforms

7.1 The Website may link to, embed or rely on third-party websites and services, such as booking calendars, payment pages, video players, social media and form tools. We do not control those services and are not responsible for their content, availability or privacy practices. Their own terms apply when you use them.

7.2 A link to a third-party site does not mean we endorse it.

8. Privacy

8.1 We collect, use and store personal information submitted through the Website in line with the Privacy Act 1988 (Cth) and our Privacy Policy, which explains what we collect, why, who we share it with and how to access or correct it.

8.2 The Website uses cookies and similar technologies to make it work, understand how it is used and improve our marketing. You can control cookies through your browser settings, although some features may not work if you disable them.

9. Disclaimers and Liability

9.1 Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

9.2 General information only. Content on the Website, including articles, case studies, videos and Free Tool results, is general information. It is not tailored advice for your business and should not be relied on as financial, legal, tax or professional advice.

9.3 Availability. The Website and Free Tools are provided on an "as is" and "as available" basis. We do not guarantee they will be uninterrupted, error-free or free of viruses.

9.4 Limitation. To the extent permitted by law, OI is not liable for any loss or damage arising from your use of, or reliance on, the Website or Free Tools, including any loss of profit, revenue, data or opportunity, or any indirect or consequential loss. Because the Website and Free Tools are free, where our liability cannot be excluded but can be limited, it is limited to $100 or, at our option, supplying the relevant content again.

9.5 Your responsibility. You are responsible for any loss OI suffers because of your breach of these Terms, including misuse of the Website or Free Tools, or submitting someone else's details.

10. Changes, Governing Law and Contact

10.1 Changes. We may update these Terms from time to time by publishing a new version on the Website. The version in force when you use the Website applies to that use.

10.2 Severability. If any part of these Terms is invalid or unenforceable, it is read down or severed, and the rest continues in effect.

10.3 Governing law. These Terms are governed by the laws of Victoria, Australia. You and OI submit to the non-exclusive jurisdiction of the courts of Victoria.
